The soldier, army sources explain, threw his rifle and said he would not fulfill the service, a decision that led him to abandon his combat troop. The fact was attributed by the military authorities as a violation of article 337 of the Code of Military Justice. He explains the following: "The military who openly refuses to comply with an order of service that is given to him by a superior, will be punished with the penalty of military seclusion."
The controversial case is based in Antofagasta, although as of this Friday it will be discussed in Santiago. The criminal lawyer, Cristián Cruz, filed an appeal for amparo on Thursday before the Martial Court to report the official reasons for the arrest, which could turn into a sentence of 10 years in prison.
"We made the decision to file this preventive protection, because we consider it an ethical duty, because it has become clear that the troops only go out to comply with orders from their superiors, without any protection," said the lawyer.
